Terms of Use
These Terms of Use govern access to Lynx, related TSS properties, and all associated features, content, systems, and services.
1. Agreement to terms
By accessing or using Lynx or any related TSS-operated property, you agree to these Terms of Use and all other policies or notices incorporated herein. If you are using Lynx on behalf of an entity, you represent that you have authority to bind that entity, and “you” includes that entity.
2. Eligibility and account responsibility
You may use Lynx only if you are legally capable of entering into a binding agreement and only in compliance with applicable law. You are responsible for safeguarding your credentials, devices, linked accounts, imported keys, and all use of Lynx associated with your account or environment.
3. Nature of the service
Lynx is an evolving software product that may include conversational interfaces, memory systems, file handling, image handling, synchronization, indexing, search, voice features, notifications, automation capabilities, and model-based generation or transformation features. TSS may alter the structure, behavior, availability, ordering, or existence of any such component at any time.
4. Acceptable use
You may not use Lynx to violate law, infringe rights, exploit protected data without authorization, generate unlawful or fraudulent content, engage in abuse, harassment, impersonation, or defamation, compromise security, or interfere with the availability or integrity of Lynx.
You may not probe, scan, scrape, benchmark, reverse engineer, or otherwise exploit Lynx or its outputs to build or support competing systems, unauthorized datasets, or derivative services without TSS’s prior written permission.
5. User content and generated content
You remain responsible for all prompts, files, imports, credentials, and other materials you submit. TSS may process those materials as described in the Privacy Policy and EULA. Rights in Lynx outputs, generated media, and machine-generated replies are governed principally by the EULA, which controls in the event of conflict with these Terms.
6. No third-party ad network; first-party service promotion
Lynx is not represented as a third-party ad marketplace. TSS may, however, display first-party notices and promotional content concerning Lynx features, service changes, availability, waitlists, pricing information, or anticipated subscription offerings, including Pro and Max tiers.
7. Service communications
You consent to receive communications from TSS concerning account administration, service updates, legal notices, operational alerts, security matters, support matters, and first-party commercial communications relating to Lynx, to the extent permitted by law and subject to any legally required opt-out mechanisms.
8. Fees and future paid plans
Certain portions of Lynx may be offered without charge, while others may become paid, metered, limited, or plan-gated. TSS may introduce, modify, or discontinue pricing, quotas, entitlements, storage limits, or subscription plans at any time. References to future plans, including Pro or Max, do not constitute a binding commitment by TSS to launch, maintain, or price any such plan in a particular manner.
9. Intellectual property
Lynx, including its software, interfaces, branding, design, workflows, compilations, look and feel, documentation, and all associated intellectual property, is owned by TSS or its licensors and is protected by applicable law. Except for the limited rights expressly granted, no license or right is conveyed by implication, estoppel, or otherwise.
10. Reservation of rights and enforcement
TSS reserves the right to monitor use, investigate conduct, preserve records, remove content, suspend access, limit features, refuse requests, deny exports, and take any action TSS determines is appropriate to protect Lynx, TSS, users, third parties, or legal compliance interests.
11. Third-party services and dependencies
Lynx may interoperate with third-party authentication providers, cloud systems, model providers, storage providers, device platforms, operating systems, or external services. TSS is not responsible for the independent acts, omissions, outages, pricing, content, or policies of such third parties.
12. Disclaimers
Lynx may produce incorrect, incomplete, or unsuitable information. TSS does not guarantee that Lynx will be uninterrupted, secure, error-free, or appropriate for any critical use. You remain responsible for review, verification, and judgment before relying on outputs or service behavior.
13. Limitation of liability
To the maximum extent permitted by law, TSS shall not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, goodwill, data, or business opportunity arising out of or relating to Lynx or these Terms.
14. Indemnity
You agree to indemnify, defend, and hold harmless TSS and its affiliates, officers, employees, contractors, successors, and assigns from and against claims, liabilities, losses, damages, and expenses arising out of or relating to your use of Lynx, your submissions, your outputs, your violation of these Terms, or your violation of law or third-party rights.
15. Governing law and dispute venue
These Terms shall be governed by the laws selected by TSS without regard to conflict-of-laws principles. Unless non-waivable law provides otherwise, disputes shall be brought exclusively in the courts selected by TSS for such matters.
16. Modifications
TSS may amend these Terms from time to time. Revised Terms become effective when posted or on the later effective date specified by TSS. Continued use of Lynx after that date constitutes acceptance of the revised Terms to the maximum extent permitted by law.
17. Contact
Questions or legal notices concerning these Terms may be directed to Tobias Schmidt Services LLC through the contact channels designated by TSS for legal matters.
